CREATOR AGREEMENT & TERMS & CONDITIONS

Welcome to the Naalayak Crew.
We're excited to have you here.
The Naalayak Crew isn't just an affiliate program—it's a community of creators who genuinely enjoy the brand and want to grow alongside it.
Our goal is to build long-term relationships rather than one-off collaborations. These Terms & Conditions help ensure that the program remains transparent, fair, and enjoyable for everyone.
By submitting your application or participating in the Naalayak Crew, you confirm that you have read, understood, and agreed to these Terms & Conditions.
1. Eligibility
To participate in the Naalayak Crew, you confirm that:
- You are at least 18 years of age, or
- If you are under 18 years of age, you have obtained permission from your parent or legal guardian to participate in the Naalayak Crew and agree to these Terms & Conditions.
By submitting your application, you represent that all information provided is accurate and truthful.
Naalayak Dept. reserves the right to request proof of age or parental/legal guardian consent where reasonably necessary.
Submitting an application does not guarantee acceptance into the Naalayak Crew.
Naalayak Dept. reserves the right to approve or reject applications at its reasonable discretion.
2. Joining the Naalayak Crew
To become a member of the Naalayak Crew, creators are required to purchase their first product using the exclusive Creator Pricing provided by Naalayak Dept.
This first purchase:
- Is not reimbursed
- Is not considered a gifted collaboration
- Is the standard onboarding process for all creators joining the Crew
Once your order has been successfully confirmed, you'll receive:
- Your personal creator (affiliate) code
- Access to your affiliate dashboard
- Access to the Naalayak Crew community
- Eligibility to participate in future creator opportunities
3. Affiliate Program
As a member of the Naalayak Crew, you may earn commission on eligible purchases made using your personal creator code.
Commissions are earned only on successfully completed and eligible customer orders.
Orders that are cancelled, refunded, fraudulent, duplicated, self-referred (where applicable), or otherwise deemed invalid by Naalayak Dept. will not qualify for commission.
Naalayak Dept. reserves the right to investigate suspicious activity and invalidate commissions obtained through fraudulent or abusive practices.
Affiliate tracking is managed through the official affiliate platform used by Naalayak Dept., and all commission calculations are based on the records maintained by that platform.
4. Commission Payments
Eligible commission payouts are generally processed within 2 business days after:
- The customer's order has been successfully completed.
- Payment has been successfully received by Naalayak Dept.
Payouts are made via:
- UPI
- Bank Transfer
- Or any other payment method agreed upon by both parties.
Naalayak Dept. reserves the right to:
- Withhold commissions relating to fraudulent or suspicious transactions.
- Reverse commissions for cancelled, refunded, disputed, chargeback, or otherwise invalid orders.
- Delay payouts where additional verification is reasonably required.
Creators are responsible for ensuring that their payout information is accurate.
Naalayak Dept. shall not be responsible for delays caused by incorrect payment information supplied by the creator.
5. Content & Community Participation
There are no mandatory posting schedules and no minimum sales requirements to remain a member of the Naalayak Crew.
However, as the brand grows, creators who consistently:
- Create high-quality content
- Stay active within the community
- Drive consistent sales through their personal creator code
- Positively represent Naalayak Dept.
- Demonstrate professionalism and reliability
will be the first creators considered for future opportunities including:
- Gifted products
- PR packages
- Paid collaborations
- Exclusive rewards
- Early access to future collections
- Brand campaigns
- Special creator events
- Other opportunities offered by Naalayak Dept.
Selection for these opportunities is based on overall contribution to the community and is not guaranteed.
Naalayak Dept. reserves the right to determine eligibility for future opportunities at its reasonable discretion.
6. Creator Responsibilities
As a member of the Naalayak Crew, you agree to:
- Provide accurate, complete, and up-to-date information during registration and throughout your participation.
- Represent Naalayak Dept. honestly, professionally, and in good faith.
- Comply with all applicable laws, advertising regulations, and platform guidelines when promoting Naalayak Dept. or its products.
- Clearly disclose affiliate relationships where required by applicable law or platform policies.
- Treat customers, fellow creators, and members of the Naalayak Dept. team with respect.
- Avoid making false, misleading, exaggerated, defamatory, or unverified statements about Naalayak Dept., its products, services, or other creators.
Creators are solely responsible for the content they publish and any claims they make while promoting Naalayak Dept.
7. Intellectual Property
All trademarks, logos, brand names, product designs, graphics, illustrations, photographs, videos, website content, marketing materials, and other intellectual property belonging to Naalayak Dept. remain the exclusive property of Naalayak Dept.
Participation in the Naalayak Crew does not transfer any ownership rights to creators.
Creators are granted a limited, non-exclusive, non-transferable, revocable licence to use official Naalayak Dept. branding solely for promoting Naalayak Dept. while actively participating in the Naalayak Crew.
This permission automatically ends upon suspension or termination from the Naalayak Crew.
Creators may not:
- Modify or misuse official branding in a misleading manner.
- Register or claim ownership over any Naalayak Dept. intellectual property.
- Represent themselves as owners, employees, or official representatives of Naalayak Dept. without written authorization.
8. Content Licence
By voluntarily creating and publishing content featuring or promoting Naalayak Dept., you grant Naalayak Dept. a worldwide, royalty-free, non-exclusive, transferable licence to:
- Repost
- Share
- Publish
- Display
- Distribute
- Promote
- Feature
- Archive
your content across:
- TikTok
- YouTube
- X (Twitter)
- Websites
- Email marketing
- Advertisements
- Printed marketing materials
- Any other promotional channels operated by Naalayak Dept.
Ownership of your original content remains with you.
Where reasonably possible, Naalayak Dept. will credit the original creator when reposting content.
9. Public Content
Any content voluntarily published publicly about Naalayak Dept., including but not limited to:
- Posts
- Reels
- Stories
- Shorts
- Videos
- Photographs
- Reviews
- Testimonials
may be reshared, reposted, or featured by Naalayak Dept. in accordance with these Terms & Conditions.
Creators acknowledge that publicly tagging or mentioning Naalayak Dept. may result in their content being featured on official Naalayak Dept. platforms.
10. Prohibited Conduct
Creators must not:
- Generate fake orders.
- Attempt to manipulate affiliate commissions.
- Abuse creator discounts.
- Create multiple creator accounts without permission.
- Place fraudulent orders.
- Encourage fraudulent purchases.
- Use stolen payment methods.
- Spam affiliate links or creator codes.
- Use bots or automated software to inflate engagement, clicks, or sales.
- Purchase fake followers, likes, comments, or engagement to misrepresent performance.
- Impersonate Naalayak Dept. or claim to speak on behalf of the company without authorization.
- Copy or imitate official communications in a misleading way.
- Misrepresent products, pricing, shipping timelines, or creator benefits.
- Harass, threaten, discriminate against, or abuse customers, fellow creators, or members of the Naalayak Dept. team.
- Engage in illegal, unethical, or deceptive marketing practices.
- Engage in conduct that could reasonably damage the reputation, goodwill, or interests of Naalayak Dept.
Violation of these Terms may result in immediate suspension or permanent removal from the Naalayak Crew.
11. Fraud, Commission Abuse & Investigations
Naalayak Dept. reserves the right to investigate any activity it reasonably believes may involve:
- Affiliate fraud
- Commission abuse
- Fake orders
- Chargeback abuse
- Coupon misuse
- Self-referrals (where prohibited)
- Artificial traffic
- Fake engagement
- Any attempt to manipulate the Creator Program
During an investigation, Naalayak Dept. may temporarily suspend creator accounts, withhold commission payments, disable affiliate codes, or restrict access to the Creator Program.
If fraudulent or abusive activity is confirmed, Naalayak Dept. reserves the right to:
- Permanently terminate the creator's participation.
- Cancel unpaid commissions.
- Reverse previously credited commissions relating to fraudulent activity.
- Pursue any additional legal remedies available under applicable law.
12. Program Changes
Naalayak Dept. reserves the right to reasonably modify, update, suspend, or discontinue any aspect of the Naalayak Crew at any time.
This includes, but is not limited to:
- Commission rates
- Creator Pricing
- Creator benefits
- Affiliate platform
- Eligibility requirements
- Rewards
- Community features
- Campaigns
- Referral structures
- Program rules
- Terms & Conditions
Where reasonably possible, significant changes will be communicated to creators in advance through email, the creator dashboard, community announcements, or other official communication channels.
Continued participation in the Naalayak Crew after such changes constitutes acceptance of the updated Terms & Conditions.
